1. Acceptance of These Terms

This website, avaaris.com (the "Site"), is owned and operated by Avaaris Solutions Inc. ("Avaaris", "we", "us", or "our"), a corporation incorporated under the laws of the Province of British Columbia, Canada. The Site is the professional site of Gurlal Brar. These Terms of Use (these "Terms") govern your access to and use of the Site and all articles, guides, code samples, and other materials published on it (collectively, the "Content"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site.

2. Informational Purposes Only; No Professional Relationship

The Content is provided for general informational purposes only. Nothing on the Site constitutes engineering, aviation, legal, or other professional advice, and nothing on the Site is a substitute for advice from a qualified professional familiar with your particular circumstances. Your access to or use of the Site does not create any professional, client, advisory, or fiduciary relationship between you and Avaaris or its personnel.

3. Verification of Content; Your Responsibility

Technical fixes and workarounds published on the Site are verified in a controlled test environment, and the tested software version and verification date are stated on the applicable page. Software behaviour changes between versions and releases, and Content that was accurate as of its verification date may cease to be accurate. Your environment, software configuration, and data differ from the test environment. You are solely responsible for backing up your files and for testing any fix, workaround, or code sample on a copy of your data before applying it to production work.

4. Disclaimer of Warranties

THE SITE AND THE CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES, REPRESENTATIONS, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. AVAARIS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT WILL REMAIN ACCURATE AFTER ITS VERIFICATION DATE.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AVAARIS, ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE OR THE CONTENT, INCLUDING WITHOUT LIMITATION LOSS OF DATA, CORRUPTION OF FILES, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT AVAARIS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISSATISFACTION WITH THE SITE OR THE CONTENT IS TO STOP USING THE SITE.

6. Intellectual Property; Limited Licence

The Site and the Content, including all text, graphics, code samples, and the selection and arrangement thereof, are the property of Avaaris or its licensors unless otherwise stated, and are protected by Canadian and international copyright and other intellectual property laws. Subject to your compliance with these Terms, Avaaris grants you a limited, non-exclusive, non-transferable, revocable licence to (a) access and view the Content for your personal or internal business purposes; (b) link to and cite the Content with attribution; and (c) use code samples published on the Site in your own projects. Except as expressly permitted above, you may not reproduce, republish, distribute, sell, or otherwise commercially exploit any substantial portion of the Content without the prior written consent of Avaaris.

7. Automated Access

Avaaris permits automated systems, including search engines and artificial intelligence systems, to crawl, index, and cite the Content, subject to these Terms.

8. Trademarks; Third-Party Content

Autodesk, AutoCAD, and Civil 3D are registered trademarks or trademarks of Autodesk, Inc., in the USA and/or other countries. Avaaris is not affiliated with, endorsed by, or sponsored by Autodesk, Inc. All other trademarks, trade names, and logos appearing on the Site are the property of their respective owners. The Site contains links to third-party websites, including the Autodesk Community forums, that are provided for convenience only. Avaaris does not control and is not responsible for the content, accuracy, or practices of any third-party website, and the inclusion of a link does not imply endorsement.

9. Independence

The Site is operated by Avaaris Solutions Inc. in its own capacity. The views expressed on the Site are those of the author alone and do not represent the views, positions, or policies of any employer or other organization with which the author is or has been affiliated. No employer or other organization has reviewed, approved, or contributed to the Content, and none bears any responsibility for it.

10. Changes to These Terms

Avaaris may revise these Terms at any time by updating this page. The "Last updated" date at the top of this page indicates the most recent revision. Your continued use of the Site after revised Terms are posted constitutes your acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or with your use of the Site, shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of laws principles. You irrevocably submit to the exclusive jurisdiction of the courts of the Province of British Columbia.

12. General

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect. No failure or delay by Avaaris in enforcing any provision of these Terms shall operate as a waiver of that provision. These Terms constitute the entire agreement between you and Avaaris with respect to your use of the Site and supersede any prior understandings on that subject.
